President Ramaphosa Initiates Inquiry into Adv. Chauke’s Competence to Serve in Office

Pretoria – An inquiry has been initiated to assess the suitability of Advocate Andrew Chauke for the position of Director of Public Prosecutions.

On Monday, 29 September 2025, the Presidency announced: “President Cyril Ramaphosa, in accordance with section 12(6)(a) of the National Prosecuting Authority Act of 1998, has established an inquiry to evaluate Advocate Andrew Chauke’s fitness to serve as Director of Public Prosecutions.”

Advocate Chauke was suspended by President Ramaphosa on 20 July 2025, receiving full pay while the inquiry is underway.

Vincent Magwenya, the President’s spokesperson, clarified that the inquiry will investigate serious allegations concerning Advocate Chauke’s competence and appropriateness to continue in his role as Director of Public Prosecutions and as a member of the National Prosecuting Authority.

Advocate Chauke has held the position of Director of Public Prosecutions since 1 September 2011.

Retired Justice Baaitse Elizabeth (Bess) Nkabine has been appointed by the President as Chairperson of the inquiry, alongside Advocate Elizabeth Baloyi-Mere SC and attorney Ms Thenjiwe Vilakazi as additional members.

According to the Constitution, the National Prosecuting Authority Act, and the principles of natural justice, the inquiry must be conducted in a fair and impartial manner regarding the allegations against any Director of Public Prosecutions.

“The inquiry Chairperson will consult with the Minister of Justice to decide on the location of the inquiry and the procedural rules,” stated Magwenya.

“Following the conclusion of the inquiry, the Chairperson is required to submit a report to the President.”
