Chief Justice Mandisa Maya Unveils New Sexual Harassment Policy for the Judiciary

Johannesday – Chief Justice Mandisa Maya has revealed the establishment of a Sexual Harassment Policy for the South African Judiciary.

She made this significant announcement on Women’s Day, Saturday 9 August 2025, aiming to preserve the integrity of the courts and uphold the dignity of everyone who serves within them.

This Policy underscores the Judiciary’s steadfast commitment to the Constitutional principles of human dignity, equality, and justice, conveying a clear message: sexual harassment is unacceptable within the halls of justice.

As guardians of the Constitution, Judges and Magistrates hold a profound responsibility to maintain the highest standards of integrity.

The Bangalore Principles of Judicial Conduct, alongside South Africa’s own Judicial Codes of Conduct, demand nothing less.

However, instances of sexual harassment within the Judiciary represent not just personal transgressions; they also undermine the rule of law, diminishing public trust and betraying the fundamental principles that the institution is meant to uphold and protect.

“This Policy is an essential and urgent response,” Chief Justice Maya stated.

“The Judiciary cannot provide justice to society if it does not first ensure it within its own ranks.

“Sexual harassment is a severe abuse of power, a violation of equality, and a blemish on the legitimacy of the courts.

“We will confront it directly, and this Policy will serve as a valuable tool in that fight.”

Key principles of the policy

  • Zero tolerance for sexual harassment directed at or by any judicial officer, staff member, or individual interacting with the Judiciary.
  • Clear, confidential, and equitable procedures for reporting and addressing complaints, with safeguards against retaliation.
  • Accountability, including disciplinary measures for violators.
  • A secure and respectful workplace, free from discrimination and intimidation.

The Chief Justice has instructed all members of the Judiciary to promptly acquaint themselves with the Policy and ensure compliance.

“This is not just a document; it is a promise to the people of South Africa. We must set a strong example,” the Chief Justice stressed.

This policy will further cultivate a culture of accountability and respect, ensuring that the Judiciary continues to serve as a beacon of justice for all.
